Who can use LastTrack

You must be 13 or older. If you're under 18, you need a parent or guardian's permission, and they agree to these terms for you. You can't use LastTrack if the law where you live doesn't allow it.

Links and accounts

Songs work by link. The owner link controls a song. The collaborator link lets people join and edit it, and the listen link lets people play it. Anyone who has a link can use it, so keep links private and replace them if one gets out. We can't recover a lost owner link unless you have a backup file.

Battles and publishing need an account. Keep your sign-in secure, and give accurate information. You're responsible for what happens under your account and your links.

Your content

You own what you make on LastTrack. Only add material you have the right to use.

To run LastTrack, you give Flection LLC a worldwide, non-exclusive, royalty-free license to host, store, copy, process, play and display your content, and to share it with the people you share it with and, if you publish it, with the public. This license ends when your content is deleted from LastTrack, except for copies kept for a short time in backups.

Shared songs are made together. When you add to a song, you let its owner and members play, edit, arrange, export and share your part as part of that song, including after you leave. Sort out credit and any commercial plans with your collaborators. LastTrack doesn't decide who owns a shared song.

Publishing and battles

Publishing a song puts it in the public gallery with your display name, where anyone can find and play it. You can unpublish it at any time.

Battles are for fun, and we don't award prizes. Hosts set themes, rules and deadlines and can remove players. Vote honestly and on your own: don't use extra accounts, trade votes or otherwise game the results. We may adjust or cancel results affected by cheating.

What's not allowed

Don't use LastTrack to:

• Break the law, or share content that infringes someone else's copyright or other rights.
• Harass, threaten or bully anyone, or post hateful, sexually explicit or violent content, including in song titles, nicknames and battle themes.
• Share anyone's personal information without their permission.
• Send spam, or make songs, tracks or accounts in bulk.
• Get around rate limits, bot checks or other protections, scrape the service, or interfere with how it runs.
• Access songs, battles or accounts you haven't been given a link or permission for.

Reports and moderation

You can report a song or battle in the app or by emailing report@lasttrack.app. We may unlist, lock or remove content, limit features, or suspend access if we believe these terms have been broken or to protect people. We'll usually act without advance notice.

Copyright complaints

If you believe something on LastTrack infringes your copyright, email report@lasttrack.app with:

• Your name and contact details, and your signature (a typed name is fine).
• The work you believe is infringed.
• The link to the song or battle on LastTrack.
• A statement that you believe in good faith the use isn't authorized by you, your agent or the law.
• A statement, under penalty of perjury, that your notice is accurate and that you own the copyright or may act for the owner.

If your content was removed and you believe that was a mistake, you can send a counter-notice to the same address. We remove repeat infringers.

Expiry and backups

Songs expire 90 days after they were last edited or opened with the owner link, and are deleted 30 days after that. Export songs and download backups of anything you want to keep. We aren't responsible for content that's lost or deleted.

Changes to LastTrack

LastTrack is free. We may add, change or remove features, or stop running LastTrack. If we ever charge for something, we'll tell you first and won't charge you unless you agree.

Other services

If you sign in with Google, Apple, TikTok or another provider, their terms also apply to that sign-in. We aren't responsible for other companies' services.

Disclaimers

LastTrack is provided "as is" and "as available". To the fullest extent the law allows, Flection LLC makes no warranties of any kind, express or implied, including that LastTrack will be uninterrupted, error-free or secure, or that content will be kept.

Limits on liability

To the fullest extent the law allows, Flection LLC won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, profits or goodwill, arising from your use of LastTrack. Our total liability for any claim about LastTrack is limited to US$50. Some places don't allow these limits, so they may not all apply to you.

Your responsibility

If someone makes a claim against Flection LLC because of your content or because you broke these terms, you agree to cover our reasonable costs of that claim, including legal fees, as far as the law allows.

Ending these terms

You can stop using LastTrack at any time. We may suspend or end your access if you break these terms or if we stop running LastTrack. The sections about your content license, disclaimers, limits on liability, your responsibility and disputes continue after that.

Governing law and disputes

These terms are governed by the laws of the State of Oregon, USA, without regard to conflict of law rules. Any dispute will be decided in the state or federal courts located in Oregon, and you and we agree to their jurisdiction. If you live somewhere that gives you the right to bring claims in your local courts or under your local law, these terms don't take that away.

Changes to these terms

We may update these terms. We'll post the new version here and update the date at the top, and if a change is significant, we'll say so in the app. If you keep using LastTrack after a change, you accept the new terms.

General

These terms and our privacy policy are the whole agreement between you and us about LastTrack. If part of these terms can't be enforced, the rest still applies. If we don't enforce a part right away, we haven't given it up. You can't transfer these terms to someone else, but we may transfer them as part of a sale or merger of our business.
